- A Buyer may only be a natural person or a legal entity that accepts these Terms and Conditions.
- The Provider offers exclusively analytical services performed electronically, resulting in individual security reports in PDF format. The report constitutes the result of an analysis or findings carried out at the Buyer’s request and is sent to the provided email address upon completion of the service.
§2. Placing an Order
- The Buyer completes the order form, selecting the desired service, its scope, and turnaround time, and subsequently submits the order.
- The order is verified by the Provider regarding the feasibility of its execution.
- If the order cannot be executed, the Provider shall inform the Buyer electronically, and the Buyer shall not incur any costs.
- If the order is verified positively, the Buyer receives a secure payment link; upon payment, the service is performed immediately.
- To fulfil the order, the Buyer is obliged to provide a correct email address for the delivery of the report and the data necessary to issue an invoice with order confirmation.
- The Provider shall not be held liable for the non-delivery of results if the Buyer provides an incorrect email address.
- Upon successful payment, the provision of the service begins immediately. By placing the order, the Buyer consents to the commencement of the service before the expiry of the statutory withdrawal period and acknowledges that once the service has begun, the right to withdraw is forfeited, in accordance with Art. 38(1) of the Polish Act on Consumer Rights.
- The ordered PDF report is sent to the Buyer’s email address upon completion, within the timeframe specified by the Buyer during the ordering process.
§3. Payment, Execution, and Delivery
- The Provider enables online payments via available systems and payment gateways (including BLIK, fast bank transfers, and payment cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, and Maestro).
- Electronic transfer transactions are processed through the PayNow payment gateway and by mElements S.A., which provides online payment processing services.
- Execution of the ordered service begins upon positive payment authorisation and the crediting of funds to the Provider’s bank account.
Upon completion of the service, the ordered report is sent to the Buyer’s email address in PDF format, within the deadline specified by the Buyer when placing the order.
- Final reports are provided exclusively in electronic form – they are not sent in hard copy. Delivery is carried out electronically by sending the PDF file to the email address specified by the Buyer.
- The services offered are analytical in nature and consist of obtaining, analysing, and contextually processing information from available and legal sources, including databases, registers, public materials, information obtained from third parties, and other accessible IT resources.
- Each service is performed individually based on the specifications and assumptions provided by the Buyer; however, the result is always dependent on data availability, the factual status, and legal or technical limitations.
- The Provider undertakes to exercise maximum due diligence in the execution of the service and to conduct the contextual analysis in accordance with the scope and methodology appropriate for the given type of service and order.
- The Buyer acknowledges that the Provider cannot guarantee a specific result, particularly where the requested information does not exist, is inaccessible, has never been recorded, or cannot be confirmed without additional actions that fall outside the scope of the order.
- An inability to establish specific information resulting from source limitations, factual circumstances, or other factors beyond the Provider’s control (e.g., where expected data does not exist) does not constitute non-performance or improper performance of the service and shall not be grounds for a complaint, withdrawal from the contract, or a refund request.
§4. Right of Withdrawal
- In accordance with Art. 38(1) of the Polish Act of 30 May 2014 on Consumer Rights, the right to withdraw from a distance contract does not apply to service contracts if the trader has begun the service with the consumer’s express consent, and the consumer was informed prior to the start of the service that they would lose their right of withdrawal once performance has begun.
- The services offered are individual and tailored to the Buyer’s specific objectives; therefore, the commencement of the order involves the immediate commitment of analytical resources.
- Consequently, withdrawal from the contract is not possible once the service has commenced, regardless of whether it has been completed in full or is in progress.
- By completing the form, checking the relevant consents, clicking the order button, and making the payment, the Buyer expressly consents to the commencement of the service and acknowledges the loss of the right to withdraw.
§5. Complaints
- Complaints regarding the execution of orders, including the non-delivery of the final report, may be submitted via email to: contact@gecs-global.com.
- The Provider shall consider complaints within 14 working days of receipt. The Buyer will be informed of the outcome via electronic communication.
- Complaints resulting from an incorrect or inactive email address provided by the Buyer will not be upheld. In such cases, the Buyer may place a new order, unless the non-delivery resulted from a technical fault on the Provider’s side.
- For individual services where execution has commenced following the Buyer’s payment, complaints cannot pertain to the cancellation of the service or withdrawal from the contract.
§6. Data Protection
- The Data Controller is POLSKI HOLDING BEZPIECZEŃSTWA Sp. z o.o. with its registered office in Warsaw.
- Personal data is processed for the purpose of fulfilling and managing orders. Details regarding processing are available in the Privacy Policy.
- The Buyer is entitled to rights under the GDPR, specifically the right to access, rectify, and erase their data.
- The Provider guarantees full confidentiality of all information and data provided by the Buyer. This data is used solely for the fulfilment of the order and the preparation of the report; following delivery, it is immediately deleted or permanently anonymised, in accordance with GDPR regulations.
§7. Final Provisions
- These Terms and Conditions are effective as of 14 August 2025.
- The Seller reserves the right to amend these Terms and Conditions; however, changes shall not affect orders placed before the new version takes effect.
- For matters not regulated by these Terms, the provisions of Polish law shall apply, in particular the Act on Consumer Rights and the Civil Code.
